Hello World! Welcome Friends! If you or a loved one lived on the Camp Lejeune military base between 1953 and 1987, you might be able to file a claim for polluted water at Camp Lejeune. This claim can help you or your family members get disability benefits, even if you’re not a military member.
Sadly, many civilian workers could not file for VA disability, as this is mainly used for veterans that suffered an injury or illnesses due to their military service. Fortunately, the new PACT act and Camp Lejeune Justice Act allow civilian members to file a claim for VA disability benefits and a civil lawsuit for additional compensation.
What are VA Disability Benefits?
The Department of Veterans Affairs provides disability benefits to veterans who suffered an injury or other related disease due to their military service. The VA compensates service members by issuing a monthly check to help cover medical expenses, continued care, occupational therapy, or to help offset their loss of income due to their disability. For instance, if a veteran sustains a back injury that continues to affect their daily life, they can file for VA Disability.
However, it’s important to note that the VA will only offer disability benefits to service members who are continuing to suffer from the effects of their injury. For instance, if you suffered a knee injury and fully recovered, you would most likely not be able to receive continued compensation.
Therefore, you must prove that the injury (physical or mental) you obtained in the military continues to negatively impact your life. Unfortunately, many people don’t understand how to prove their injury continues to reduce their quality of life. As a result, many claims are denied improperly.
How Do I Quality For VA Disability Benefits For Camp Lejeune Toxic Water?
VA disability benefits are available to military service members and benefits, but not to civilians. For instance, if you are a government employee that worked on a military base, you cannot file for VA disability compensation. However, this changed with the signing of the PACT act by president Joe Biden on August 8, 2022.
The PACT act expanded VA disability benefits to service members and civilian workers, as well as their family members affected by the toxic water at Camp Lejeune. This toxic water contained solvents that caused diseases, including:
- Bladder cancer
- Breast cancer
- Esophageal cancer
- Female infertility
- Hepatic steatosis
- Kidney cancer
- Leukemia
- Lung cancer
- Miscarriage
- Multiple myeloma
- Myelodysplastic syndromes
- Neurobehavioral effects
- Non-Hodgkin’s lymphoma
- Renal toxicity
- Scleroderma
Suppose you have suffered from any of the above illnesses, were stationed or worked on the Camp Lejeune base between 1953 and 1987, were exposed to the water for 30 consecutive days, and did not receive a dishonorable discharge. In that case, you can file for VA disability benefits. You can also file a civil lawsuit. Any settlement money you receive will be offset by the amount of VA disability benefits you receive.
How Much Compensation Will I Receive?
The VA issues disability ratings based on the severity of your illness. For instance, if you only suffer minor effects from your injury or are completely recovered, you might receive as little as 10% disability. Your claim might also be denied altogether. However, suppose you file a claim for polluted water at Camp Lejeune and prove that your injuries are extensive. In that case, you might receive a higher disability rating, which translates to higher monthly compensation.
In addition, you can also file a civil lawsuit for additional settlement money. A good legal team can help you file a civil lawsuit and argue for more settlement money based on your emotional damage, pain, and suffering.
